Q6: Whatisthe“alternativemeasure”? Whoarethe“specifiedpersons”? A6: Weunderstandthatsomepersonsmaynotbeabletocomplywiththerequirementofusing“LeaveHomeSafe”duetoalegitimatereason. Therefore,threetypesofspecifiedpersonsareallowedtocompleteaspecifiedformasanalternativemeasureforcomplyingwiththerequirementonusing“LeaveHomeSafe”. Specifically,thethreetypesofpersonsare: personsaged65oraboveorpersonsaged15orbelow;or personswithdisability;or otherpersonsrecognisedbytheGovernmentororganisationsauthorisedbytheGovernment[Note]aseligibleforthearrangement. Iftherelevantpremisesisequippedwiththeupdatedversionofthe‘QRCodeVerificationScanner’(version4.4.3orabove)developedbytheGovernmentandperson-in-chargeofthepremisesusesittoscantheQRcodeoftheVaccinationRecordorExemptionCertificate(asappropriate)ofcustomer(s)belongingtoanyoneofthethreecategoriesofpersonsabove,thentheperson(s)concernedwouldbedeemedtohavecompliedwiththerequirementtousethe‘LeaveHomeSafe’mobileapplicationtorecordhis/hervisiteventhoughhe/sheisunabletodoso. Inotherwords,ifthepersonsabovearetoenterotherVaccinePassscheduledpremisesnotequippedwiththe‘QRCodeVerificationScanner’(e.g.premisessubjecttopassivecheckingofVaccinePass),theystillneedtoregistertheirpersonalinformation(includingname,contactnumberanddateandtimeofthevisit)inaspecifiedformasanalternative. ThespecifiedformcanbefoundontheFEHDThematicWebpage(https://www.fehd.gov.hk/tc_chi/events/covid19/vaccine_bubble_download.html). Ifapersonregistershis/herpersonalinformationinthespecifiedformasanalternativetousing“LeaveHomeSafe”,itmeansthatthispersonisdeclaringhimself/herselftobeaspecifiedpersonreferredtoabove. Apersonwhomakesfalsedeclarationorprovidesfalseinformationisguiltyofanoffence. Person-in-chargeofpremisesshouldusethelatestversionofQRCodeVerificationScannermobileapp(Version4.4.3orabove)cancheckiftheQRcodeiscompliantwiththerequirement,displaysthecheckresultsandemitsrelevantsounds.IfpersonsunderAmberCodeorRedCodetrytoenterpremises,eventhecustomermaynotusethelatestversionof"LeaveHomeSafe"andtheVaccinationRecordshowsasaBlueCode,orhe/sheisholdingpapercopyofVaccinePassQRCode,theQRCodeVerificationScannermobileappcandifferentiatepersonsundercategoriesofRedCodeorAmberCode,anddisplays“EntryDenied”andplaywarningsignals.Person-in-chargeofthepremisesmustrefuseentryofcustomersorvisitorswithRedCodeorAmberCode. Q14: Willcateringpremisesorscheduledpremisesbeheldlegallyliableforfailingtocomplywiththerelevantrequirementrelatingtoensuringthatcustomershavescannedthe“LeaveHomeSafe”venueQRcodewiththeirmobilephones? A14: WheretheoperatorsofthepremisesareinbreachoftherequirementsunderCap.599FoftheLawsofHongKong,theymaybeliabletoprosecutionand,onconviction,toamaximumfineof$50,000andimprisonmentforsixmonths. Inaddition,thepremisesmust,onidentificationofnon-compliancebylawenforcementofficers,adoptcorrespondingmeasurestoreducetheriskoftransmissionforaperiodof14days,startingfromthesubsequentday.Thatis,(a)inrespectofcateringpremises,theycanprovidedine-inserviceuntil6:00p.mandnomorethantwopersonsmaybeseatedtogetheratonetable.;or(b)inrespectofscheduledpremiseswhichareonlyallowedtooperateunderthe“VaccinePass”arrangements,theymustclosefor14days. Q15: Ifcustomersuseafaked“LeaveHomeSafe”app,willboththepremisesoperatorsandthecustomersbepunished? A15: Ifcustomersuseafaked“LeaveHomeSafe”app,thenon-complianceinvolvedmayinclude: provisionoffalsestatementsbycustomers;and/or omissionofduediligencecheckbyoperatorsofpremises. For(a),customerswhofurnishfalseinformationwillbecriminallyliable. Whethertheinformationisafalsestatementwillbejudgedbythelawenforcementofficers. For(b),theexistingdirectionsunderCap.599Frequirethepremisesoperatorstoensurethatcustomershavescannedthe“LeaveHomeSafe”venueQRcodewiththe“LeaveHomeSafe”mobileappontheirmobilephonesbeforeenteringthepremises. Premisesoperatorwhocontravenestherelevantrequirementscommitsanoffenceandisliableonconvictiontoafineatlevelfiveandimprisonmentforsixmonths. UnderCap.599F,itisadefenceforapersonchargedwiththeaboveoffencetoestablishthat,atthetimeoftheallegedoffence,thepersonhadlawfulauthorityorreasonableexcuseforcontraveningtheprovisionconcernedortakenallreasonablestepstocomplywiththedirections. Theoperatorofthepremisesisresponsibleforensuringthatcustomershavescannedthe“LeaveHomesafe”venueQRcodewiththe“LeaveHomeSafe”mobileapp. Ifacustomerisfoundusingafaked“LeaveHomeSafe”app,lawenforcementofficerswill,basedonthecircumstancesofeachindividualcase,decidewhetherornottoprosecute,giveaverbalwarningtoorinitiatecriminalprosecutionagainstthepremisesoperators. Evenifacustomerisfoundusingafaked“LeaveHomeSafe”app,lawenforcementofficersgenerallywillnotinitiatecriminalprosecutionagainsttheoperatorofthepremisesprovidedthatthepremisesconcerneddoesnotcontraveneotherdirectionsunderCap.599FandthelawenforcementofficersaresatisfiedthattheoperatorofthepremiseshastakenallreasonablestepstocomplywiththerelevantrequirementsunderCap.599Finensuringthatcustomersuse“LeaveHomeSafe”. Thereisnoneedtoworryonthepartofthetradeifallreasonablypracticablemeasureshavebeentakentocomplywiththerelevantrequirements. Q16: DolawenforcementofficersoftheGovernmenthavethepowertocheckthe“LeaveHomeSafe”mobileapprecordsofcustomersofcateringpremisesandscheduledpremises? A18: Thelaunchofthe“LeaveHomeSafe”mobileappbytheGovernmentaimstoprovidemembersofthepublicwithaconvenientdigitaltoolforrecordingthedateandtimeoftheirvisitstodifferentvenues. Themobileappcanissueanexposurenotificationandfollow-upadvicetoauserinatimelymannerifhe/sheislateridentifiedtohavevisitedthesamevenuethataconfirmedpatientorapersonwhohasbeentestedpreliminarypositivevisitedataboutthesametime. Intheunfortunateeventofinfection,theuser'svisitrecordsstoredintheappcanassisttheCentreforHealthProtectioninconductingtheworkofcontacttracing. AvenueQRcodeissuedforthe“LeaveHomeSafe”mobileappisusedforrecordingthedateandtimeofvisitonly. Itdoesnotdenotetheoperationstatusofthepremises,andshouldnotberegardedasaproofoflawfulbusinessoperation. Infact,venueQRcodesareavailableatmanypremiseswithoutanybusinessoperation,suchasgovernmentofficebuildingsandpublictoilets. Toascertainwhetherthecateringpremisesarelicensed,customersshouldcheckthelicencedisplayedinaconspicuousplaceneartheentranceofthepremisesortheinformationonlicensedpremisesontheFEHDwebpage(https://www.fehd.gov.hk/english/licensing/list_licensed_premises.html). OperatorsofdifferenttypesofpremisesmayapplyforavenueQRcodebyvisitingthe“LeaveHomeSafe”thematicwebsite(https://www.leavehomesafe.gov.hk/en/)administeredbytherelevantgovernmentdepartment. Ifmembersofthepublicdetectanyirregularityonthe“LeaveHomeSafe”QRcodepostedatthepremises,theymayinformtherelevantgovernmentdepartmentbyfillinginthe“ContactUs”formonthe“LeaveHomeSafe”thematicwebsite. Theycanselect“ReportincorrectlypostedQRcode”under“TypeofEnquiry”andprovidethenameandaddressofthepremisesforfollow-upactionsbytheGovernment. Q19: Ifcustomersmakeagroupvisittocateringpremisesorscheduledpremises,arethereanyarrangementstosimplifytheproceduresforthemtouse“LeaveHomeSafe”orcompletethespecifiedformtoregistertheirpersonalinformation?
